Please read these Terms of Service ("Terms," "Agreement") carefully before using the Mero Pusta web and mobile applications ("Service" or "Platform") operated by Mero Pusta. Access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
⚖️ BINDING LEGAL AGREEMENT
By creating an account, clicking "I Agree," or accessing any part of Mero Pusta, you enter into a legally binding agreement with Mero Pusta. You represent and warrant that you have the right, authority, and capacity to enter into this agreement under Nepalese and applicable international laws.
1. Eligibility Requirements & Age Restrictions
Your access to Mero Pusta or specific sub-modules depends on your age:
- General Application & Family Tree Features: You must be at least 13 years old to register an individual account. Users under 13 must have parental or legal guardian consent and active supervision.
- Matrimonial Matchmaking Service (Shubha Lagan): You MUST be at least 20 years old to register, create, search, or view matrimonial profiles. This is in strict compliance with the Nepal Civil Code, 2074 which defines the legal age of marriage in Nepal as 20 years. Any attempt by an underage user to access or register on the matrimonial service will result in an immediate and permanent account ban.
2. User Content & Representational Authority
Mero Pusta allows you to upload photos, digital invitations, family historical documents, and map family trees (such content, "User Content").
- Owner Rights: You retain ownership of any intellectual property rights in the content you upload. Mero Pusta does not claim ownership over your family tree data or documents.
- License to Platform: By uploading Content, you grant Mero Pusta a worldwide, non-exclusive, royalty-free, fully paid-up license to host, store, replicate, and render your content solely for the purpose of operating, protecting, and displaying the Service to you and your authorized family members.
- Representational Authority for Family Tree: You acknowledge that family tree building involves entering names, dates, and locations of third-party individuals (your relatives). You warrant that you have obtained appropriate consent from living family members before mapping their private details. You assume full legal responsibility for any claims of privacy intrusion arising from unconsented genealogical entries you perform.
3. Acceptable Use Policy & Community Rules
You agree not to engage in any prohibited activities, which include but are not limited to:
- Providing false or misleading information during registration, matrimonial profile setup, or user verification.
- Impersonating another person, family member, or legal entity.
- Uploading defamatory, abusive, offensive, pornographic, harassing, obscene, or racially/ethnically offensive materials.
- Using the Platform for money laundering, commercial advertising, spamming, or collecting personal data for external marketing.
- Attempting to bypass security blocks, scrape database records, reverse engineer the compiled web or mobile code, or compromise the database server.
4. Strict Anti-Dowry Declaration
Mero Pusta strongly supports the preservation of cultural values while actively fighting harmful social evils. In compliance with the Social Behavior Reform Act, 2033 (सामाजिक व्यवहार सुधार ऐन, २०३३) of Nepal, which bans the demanding or receiving of dowry (Daijo/Tilak):
- Zero Tolerance: Mero Pusta operates as a strictly dowry-free matrimonial and family matchmaking space. No user is permitted to use our matchmaking chats, profile bios, or search metrics to negotiate, request, demand, promise, or coordinate dowry, tilak, or coercive financial exchanges.
- Reporting: Users are encouraged to report any profile or message suggesting a dowry demand. Verified dowry demands will result in immediate termination of the offender's profile and, where applicable, report submission to Nepalese law enforcement.
5. Disclaimers & Entertainment Waiver
- Horoscope & Astrological Readings: Astrological charts, daily panchang, tithi, and rashi compatibility reports generated by Mero Pusta are for cultural orientation, self-reflection, and entertainment purposes only. They do not constitute legal, psychological, or professional advice.
- Matrimonial Suggestions: Match suggestions provided by Mero Pusta's Shubha Lagan system are based on user-entered attributes. Mero Pusta does not conduct extensive offline background checks on matrimonial registrants. You are solely responsible for conducting independent background verification, character analysis, and safety checks before entering any personal commitment or offline meeting with a suggested match.
- Platform Availability: Mero Pusta is provided on an "as is" and "as available" basis. We do not warrant that the platform will run uninterrupted, error-free, or be free of secure system failure.
6. Limitation of Liability
To the maximum extent permitted by the laws of Nepal (including the Consumer Protection Act and Electronic Transactions Act):
Mero Pusta, its directors, employees, or tech partners shall not be held liable for any direct, indirect, incidental, special, exemplary, punitive, or consequential damages resulting from:
- Your use or inability to use the Service.
- The conduct, communication, or offline behavior of any user of the Platform (including matrimonial matches).
- Unauthorized access, database breach, loss of family data, photos, or documents.
- Any inaccuracy or error in Nepalese calendar, astrological calculation, or event invitation metrics.
7. Account Termination
We reserve the right, without prior notice and at our sole discretion, to terminate, suspend, or restrict your access to Mero Pusta for reasons including but not limited to:
- Breach of any section of these Terms.
- Repeated reports of harassment, abuse, or fraudulent matchmaking practices.
- Engaging in illegal activities or violating Nepalese cybersecurity or social behavioral regulations.
You may voluntarily delete your account at any time. Upon termination, your private family tree records and documents stored on your account will be marked for permanent deletion from active servers.
8. Governing Law & Dispute Resolution
This Agreement and your use of Mero Pusta are governed by and construed in accordance with the laws of Nepal, without giving effect to any principles of conflicts of law. Any legal action, dispute, or claim arising out of or relating to this Agreement or our Service shall be settled exclusively in the competent courts of Kathmandu, Nepal.
